GRESHAM — An Oregon City doctor will spend two months in jail after he advised a patient that having sex with him would help her pelvic pain, then billed the Oregon Health Plan for his time during their sessions.

Dr. Randall J. Smith, 50, must also perform 200 hours of community service and pay $1,105 in fines as part of a plea agreement, Rodney Hopkinson, a senior assistant attorney general for the Oregon Department of Justice, told a Portland newspaper.

Hopkinson said Smith, who worked as an osteopath at the Adventist Health Clinic-Rockwood in Gresham, also was sentenced to 18 months probation by Multnomah County Circuit Judge Julie Frantz on Monday.

Smith surrendered his medical license to the Oregon Board of Medical Examiners on March 4, officials said.

Hopkinson said the woman told officials that Smith told her massaging her “trigger points” would alleviate her pain. Eventually, he said, the therapy involved sexual intercourse.

Smith told prosecutors that the sex was consensual.

Hope it was protected sex and I wonder which brand condom.

I see the commercial now: "Trojans are recommended by 1 out of 1 doctors that bill for illegal sex with their patients"

This guy is an osteopath. I don't follow with how sex will alleviate pelvic pain. I'd think the old bump and grind would exacerbate that. I'd like to hear from the MDs and med school students on this though.

When I read this I couldn't believe that the woman fell for what the doctor was telling her. My physicians have always taken the time to explain to me how treatments would work. Why not just sex with someone of her choosing? I think it is highly unethical and the doctor should lose his license (you just flat out don't have a relationship with a patient) but I question the woman's "victimization" at the same time.

The article says he did surrender his license. I am wondering though, if he had not billed the state for the sex and if he had told her sex with just about any partner would be OK, would it have been OK since it appears it was otherwise consensual?

BTW, I'm not taking up for this guy!

I'd say no. As much as anyone could ever try to call it "just sex," as a doctor you have a responsibility (that I think your license depends on) to avoid doctoring for people with whom you have relationships because your professional opinion may be compromised. So, I think simply having sex with her period while being her doctor was unethical. Not saying you can't provide advice to your family - but you wouldn't do surgery on your sibling or wife or anything.

Posc, you are a marketing genius. Brilliant even if I don't support your views on Bush!

I also agree with y2benji. What would happen if you got caught having sex with a client or customer? You'd be fired. Patients are the same thing.

cause if she did, i make my own "p***scillin" for anyone with a sore throat!

seriously, he should lose his license. how do docs continue to make mistakes like this, they get caught all the time. who hasn't heard of numerous stories where pediatricians date their patients' mothers.

The patient must have consented to this, hello what woman is that stupid to think this Doc was telling the truth?? Or is that an Oregon thing?? I really dont feel badly for this patient, obviously shes an idiot or a medicaid whore looking to con another hard working citizen out of his money. If she was smart enough to call an attorney & try to ruin this guy, shes probably the medicaid whore. For his sake I hope he used a condom, eeew!!
